The skill of the advocate

The evidence of witnesses lies at the heart of the criminal justice system.

Magistrates, judges and juries will have to assess whether they can be sure what a witness has told them is correct, i.e. is there room for confusion, mistake, have they blatantly lied, are they exaggerating, are they telling the whole truth?

The skill of an advocate lies in taking a witness through their evidence to elicit all the information that is required (examination-in-chief) or in the ability to test or undermine a witness’s evidence to expose a doubt.
